    Where a San Diego Subpoena Dispute Is Heard

    A motion to quash a subpoena, or to compel compliance with one, is a law and motion matter heard in the case’s civil Independent Calendar department. Under Local Rule 2.1.19 those departments hear motions by appointment only, and unscheduled motions are not heard, so the hearing date is reserved first, usually through the court’s Motion and Reservation System.

    For an out-of-state case, a dispute over a subpoena issued under section 2029.300 is filed in the San Diego Superior Court under Code of Civil Procedure section 2029.600. We keep the service record ready for either kind of hearing.

    Out-of-State Cases With San Diego Witnesses

    When a case is pending in another state but the witness or records are in San Diego County, the foreign subpoena is submitted to the clerk of the San Diego Superior Court, who issues a California subpoena under Code of Civil Procedure section 2029.300. No civil case cover sheet is required. A California attorney retained in the matter can also issue it under section 2029.350.

    Once issued, the subpoena is served under California rules. Civil filings in the Central Division go to the Civil Business Office, 330 West Broadway, Room 225.
