San Diego’s general civil cases run through two divisions, not a dozen courthouses. Limited and unlimited civil cases from East and South County are part of the Central Division, handled at the Hall of Justice, 330 West Broadway, while most North County cases go to Vista. Attorneys for represented parties must file electronically, and the court asks e-filers to use its published filing names; a document designated under the wrong name slows processing, and the clerk does not have to warn you before your deadline runs.

    Filing Names: The Detail San Diego Asks E-Filers to Get Right

    The Civil Division has moved to a new case management system, and the court says it is processing filings in the order received while it works through a backlog, with time-sensitive matters handled first. Its civil e-filing page asks every e-filer to check the Civil Filing Names and Unlawful Detainer Filing Names references before submitting, because a filing given the wrong designation adds work and delay.

    Reserving a Motion Date Before You File

    Under Local Rule 2.1.19, law and motion matters in San Diego’s civil Independent Calendar departments are heard by appointment only. Most departments take reservations through the court’s Motion and Reservation System; cases in Department 501 or 61 are not currently eligible for it, and those dates come from calling the assigned department, as the court’s hearing page explains.

    Ex parte reservations are made by calling the assigned department, and notice to the other side is due by 10:00 a.m. the day before the hearing. Both motions and ex parte applications carry a fee at filing unless a fee waiver is on file.

    Which Division Takes Your San Diego Case

    Venue starts with the Zip Code List, but the court’s where-to-file rules fold several areas together. For civil limited and unlimited cases, East and South County are part of the Central Division at 330 West Broadway. For unlawful detainers, East, North and South County all file in the Central Division, Room 225.

    Construction defect cases are filed in the Central or North County Division through approved providers, false claims actions go to the Central Division, and CEQA cases from East and South County are filed in the Central Division.     What time does an e-filing count as filed in San Diego?

    Up to 11:59:59 p.m. on a court day. Under Code of Civil Procedure section 1010.6, a document received electronically by then is deemed filed that day, and one received on a non-court day counts for the next court day. Paper filings have to reach the Civil Business Office during its hours, 8:30 a.m. to 4:00 p.m., Monday through Friday.

    Is e-filing mandatory in San Diego?

    We correct the document and refile. A common cause in San Diego is a filing submitted under a name that does not match the court’s Civil Filing Names list; others are a missing signature, a fee that does not match or a document that is ineligible for eFiling. Submitting early leaves room for that second attempt.

    Do you handle both electronic and paper filings?

    Yes. We e-file through an approved provider and take paper filings to the Civil Business Office, Room 225, when a document is ineligible for eFiling or the filer is self-represented. One call covers whichever route your document needs.

    Do I get a conformed copy of my San Diego filing?

    Yes. Once the clerk accepts the document, the file-stamped copy is released and we send it to you. For Civil, Small Claims and Probate cases, many documents can also be previewed on the court’s online Register of Actions and downloaded for a fee.

    How do motion deadlines affect my filing date in San Diego?

    Are construction defect cases e-filed in San Diego?

    Yes. Cases primarily involving construction defect claims are filed in the Central or North County Division through the court’s approved providers. They once went through File & ServeXpress, and East and South County cases of this type are handled in the Central Division.

    Does the San Diego court accept fax filings?

    Under Local Rule 2.5.2, the court accepts documents from fax filing agencies, except those excluded by the Rules of Court. In limited civil cases, a document that needs no payment can be faxed directly, and conformed copies of it are sent only on request with a stamped envelope and the copy fee.
