Can Someone Else Accept Served Papers in California?
Yes, in certain cases. In California, a process server can leave papers with someone “of suitable age and discretion” at the intended recipient’s home or workplace if the recipient isn’t available. This method is called substitute service, but it must meet strict legal requirements to be valid.
What Is Improper Service of Process?
Improper service happens when legal papers aren’t delivered following California law. This could mean that papers were left with the wrong person, delivered incorrectly, or not filed properly with the court afterward. Furthermore, improper service can delay or even dismiss a case.
How Many Times Can a Process Server Come to Your House in California?
There’s no legal limit to the number of attempts a process server can make. Professional servers usually try three to five times on different days and times before using alternative methods like substitute service or requesting court permission for other options.
How Do You Prove You Were Not Served Properly?
To prove that you were not properly served, you’ll need to present clear evidence. This might include showing that you never lived at the address where service was attempted, that you were not present at the time and no valid substitute service occurred, or that the process server’s declaration (also known as the proof of service) contains mistakes or false information. Supporting materials like witness statements, mail records, or surveillance footage can also help strengthen your claim.

Legal Process Outsourcing (LPO) is the practice of hiring an external company to handle legal support services such as document review, legal research, case management, and process serving.
