How quickly can a document be filed once I send it?

Documents sent during business hours are filed the same day in most California courts, provided they arrive before that court’s cut-off for the day. Cut-offs vary by county and by division, and electronic filing usually runs later in the day than counter filing. When a deadline is tight, send the document with the deadline noted and it goes to the front of the queue. You receive confirmation once the court accepts the document, along with the conformed copy. If a court has already closed for the day, the filing goes in at the next available opening rather than waiting for a batch.

Which California courts accept electronic filing?

Most California superior courts now accept or require electronic filing for civil cases, under California Rules of Court rule 2.253. Each court adopts its own local rule, so the requirement is not uniform across the state, and some case types and documents remain paper-only even in courts that have gone electronic. You do not need to work out which applies to your matter; send the document and the correct route is used.

What happens if the court rejects my filing?

Rejections are common and usually procedural: a missing signature, a wrong case number, an incorrect fee, a caption that does not match the court’s format. When a court rejects a document, you are told the same day with the reason the clerk gave. The document is corrected where the fix is clerical and resubmitted, or returned to you where the change is substantive and needs your decision. Rule 2.259 of the California Rules of Court sets out how a rejected electronic filing is treated for deadline purposes, which is worth reading when a rejection lands near a cut-off date.

Do you file in all 58 California counties?

Yes. Filing runs across every county in the state, electronically where the court supports it and in person where it does not. Coverage includes the large urban courts such as Los Angeles, San Diego, Santa Clara, Alameda, Sacramento and San Francisco, and the smaller rural courts where counter filing is still the only option. A single account covers all of them, so a firm handling matters in several counties does not need separate arrangements for each one, and the same tracking applies wherever the document goes.

What is a conformed copy and when do I receive it?

A conformed copy is your document stamped by the clerk showing the date and time the court accepted it. It is the proof that the filing happened and when. For electronic filings the conformed copy comes back as a stamped PDF, usually within the same business day the court processes it. For counter filings it is the physical copy stamped at the window, returned to you scanned and, where you need it, by hand. Keep it: courts sometimes have no record readily available later, and the conformed copy is what settles the question.

Can you file documents under seal or lodge exhibits?

Yes, and these follow different rules from ordinary filings. Documents filed conditionally under seal require a motion and a specific format under California Rules of Court rules 2.550 and 2.551, and courts vary in how strictly they apply the packaging requirements. Lodging is not the same as filing: a lodged document is delivered to the court for reference without becoming part of the case file. Tell us which one you need when you send the document, because sending a lodging as a filing is one of the more common causes of rejection.

How are court filing fees handled?

Filing fees are advanced on your behalf and appear on your invoice with the court receipt attached, so the fee your firm pays matches the fee the court charged. First appearance fees, motion fees and complex case fees differ by case type and by court, and they change when the Legislature amends the schedule. Where a fee waiver applies, the waiver paperwork goes in with the filing. You are not asked to pre-fund an account or to guess the fee before the document is sent.

Can you handle ex parte and same-day emergency filings?

Yes. Ex parte applications carry their own notice requirements and appearance times, and the appearance is usually set for the morning, which leaves a narrow window to get papers in front of the right department. Send the application with the hearing date and department noted and it is filed and delivered to the department the court directs. Where a court requires a courtesy copy for the judge in addition to the filed original, that is delivered as part of the same job rather than treated as a separate request.

Can I track a filing without calling for an update?

Every filing is tracked through your account, showing when the document was received, when it went to the court, and when the court accepted or rejected it. Status is available at any hour rather than during office hours only, so a paralegal checking a deadline in the evening does not have to wait until morning. Confirmations and conformed copies attach to the same record, which means the audit trail for a document lives in one place rather than being reconstructed from email threads later.

What else can be handled alongside a filing?

Filing is rarely the only step in a matter. Service of process, county recorder filing, document retrieval, subpoena preparation and messenger runs are handled through the same account, which matters when a document has to be filed and then served within a set period. Sending both instructions together avoids the gap that appears when two vendors each wait on the other. Where a matter needs a deposition officer or a court reporter, those are arranged through the same route. Bundling the instructions also keeps one record of what happened and when, which is what you want if a deadline is ever questioned.

I had to file a Writ of Review with the California Court of Appeal. I contact several services for assistances most were not interested and others didn't provide the services I needed. I called On-Call Legal Process Servers and spoke to one of their staff. The staff member gave me a list of services they provide everything from a small claims court, to Court of Appeal to the Supreme Court. They will assist you in the filing all court documents and proof of service. To get start with On-Call Legal Process Servers and more an account has to be opened online. Before charges can be posted to the account an Email is sent out listing the proposed charges. The staff returns Email questions and orders during their normal business hours during the same day. On-Call Legal Process Servers file the writ for me and obtain the filing court's case number.
