    Ex Parte Deadlines Change by Department

    Orange County’s Local Rule 359 has ex parte applications heard by the judicial officer assigned to the case, and each department sets its own timing on the court’s civil calendar. Some require a reservation by noon the court day before and filing by 2:00 p.m.; others want the application by noon and a courtesy copy by 2:00 p.m.; several rule on the papers without appearances unless they notify the parties.

    An ex parte filed with a new unlimited complaint follows its own schedule, set out on the court’s ex parte page: e-file and pay by 1:15 p.m., appear at 1:30 p.m. at the Central Justice Center. We check the department’s rules for each application.

    The 24-Hour Rule for Reserved Motions

    For unlimited civil motions, the court’s reserve-a-motion-date system cancels a reservation automatically if the moving papers are not filed within 24 hours. Several departments exempt summary judgment motions from that rule, and hearings on a claim of exemption cannot be reserved online.

    Discovery motions need a separate reservation and filing fee for each party compelled to respond to each type of discovery request. We reserve and file together so a date is never lost.

    Limited Civil in Departments C61 and C66

    Limited civil cases, those seeking $35,000 or less, follow a lighter process. Ex parte applications in the limited civil departments are heard Monday through Friday at 1:45 p.m. and ruled on in chambers without appearances unless specially set, and law and motion there requires no reservation.
