Santa Clara County has simplified where civil papers go: since July 1, 2024, Civil Local Rule 1(C) sends every limited and unlimited civil case to the Downtown Superior Court. What has not simplified is the timing. The clerk’s office is open to the public only Monday to Thursday from 8:30 a.m. to 3:00 p.m. and Friday until noon, a motion filed without a reserved hearing date is rejected, and the drop box has its own cutoff.

    Reserving a Hearing Date Before the Motion Goes In

    In Santa Clara County the moving party reserves a hearing date, online or by phone, before filing a motion; motions filed without a date are rejected, according to the court’s civil updates page. The moving papers must follow within five business days of the reservation, or the date is released, except in the complex departments.

    Civil Local Rule 8(A)(2) also asks the parties to meet and confer on hearing dates, and only one date may be reserved for any motion. Law and motion calendars run Tuesday and Thursday in Depts. 1, 6 and 10, and Wednesday and Friday in Depts. 11, 12 and 16, at 9:00 a.m.

    Ex Parte Applications Decided on the Papers

    Since January 1, 2026, Civil Local Rule 7(C) has counsel e-file ex parte applications, with notice to the other side no later than 10:00 a.m. the court day before, and a proposed order attached to Form EFS-020. The court decides them on the papers unless it orders otherwise, generally within 24 to 48 hours.

    Self-represented litigants may still file ex parte applications on paper through the drop box at the Downtown Superior Court. We prepare the notice and the filing together so the application is not held up.

    The Civil Lawsuit Notice That Travels With the Complaint

    Every new civil complaint in Santa Clara County is filed with a blank Civil Lawsuit Notice, Form CV-5012. The clerk fills in the judge, the first hearing date and the department, and the notice must be served with the complaint, under Civil Local Rule 1(D) in the court’s civil rules. Collections cases under Rule of Court 3.740 use Form CV-5052 instead.

    How late can a document be filed on its due date?

    For e-filings, a document received by the court before 11:59:59 p.m. on a court day is deemed filed that day under Code of Civil Procedure section 1010.6, so a deadline can still be met after the clerk’s counter closes. Paper filings have to reach the courthouse window during business hours, so send those as early as you can. In Santa Clara County the clerk’s office takes paper Monday to Thursday until 3:00 p.m. and Friday until noon, and documents in the lobby drop box by 4:00 p.m. are deemed filed that day.

    Is e-filing mandatory in San Jose?

    What happens if the court rejects my filing?

    Clerks reject filings for a missing signature, a fee that does not match the document, formatting that breaks the rules, or the wrong venue. When that happens, we contact you with the reason and the correction, then refile as soon as it is fixed. Because we submit early rather than at the deadline, there is usually time to correct and refile. In Santa Clara a motion filed without a reserved hearing date is also rejected.

    Do you handle both electronic and paper filings?

    Yes. We file electronically through an approved Electronic Filing Service Provider, and we file on paper at the courthouse counter when a document has to go that way, whether the filer is exempt, an exhibit is oversized, or the portal will not take the document. One call covers whichever route your document needs. The court does not take faxes directly; a fax filing agency can be used instead.

    What are conformed copies, and do I get them back?

    A conformed copy is your document stamped with the court’s file date once the clerk accepts it, and it is your proof the filing is on record. We return the conformed copy after acceptance. If your courtroom also wants a paper courtesy copy in chambers, we deliver that as well. Copies from the court’s Case Information Portal cost 50 cents a page.

    How do motion deadlines and mail extensions affect my filing date?

    Motion notice periods run off the filing and service date under Code of Civil Procedure section 1005, and when you serve by mail, section 1013 extends the other side’s response window based on the mailing date. Tell us your hearing date and we work the filing backward from it, then flag any window that looks too tight before we submit. In Santa Clara County the hearing date is reserved first, online or by phone, and only one date may be reserved per motion.

    Can you file physical exhibits the portal will not take?

    Yes. When an exhibit is oversized or a document type is one the e-filing portal will not accept, we file it on paper at the correct courthouse and get it to the clerk inside that day’s window. If a case qualifies for a fee waiver, tell us and we file the waiver request alongside the document. Bonds, undertakings, wills and trial exhibits cannot be e-filed in Santa Clara, so those go to the clerk.

    What is Form CV-5012 in Santa Clara County?

    The Civil Lawsuit Notice. A blank copy is filed with every new civil complaint, the clerk completes the judge, hearing date and department, and it must be served with the complaint under Civil Local Rule 1(D).

    When are Santa Clara tentative rulings posted?
