What changes when the address is in Irvine

Irvine assignments turn on local details. Who is being served? Do they live behind a gate or work out of a shared office? Is a public body on the other side of the case?

Guard-gated villages

Many Irvine addresses sit behind gatehouses in the master-planned villages. Under Code of Civil Procedure section 415.21, a registered process server who shows a current driver’s license or other identification, plus evidence of current registration, must be let in for a reasonable time for the sole purpose of serving papers. The rule applies only while a guard or other security staff assigned to control access is on duty.

Keypad and call-box gates are a different story. The statute doesn’t cover them, so any gate code or call-box detail you give us at intake is what gets the server to the door. Apartment communities and leasing offices

Section 415.21 also reaches staffed apartment buildings with three or more units and condominiums with four or more, so a building with a concierge or security desk on duty has to give a registered server access in the same way. In a large managed community, the unit number is often the detail that decides whether an attempt succeeds.

A leasing office is a different matter. Substituted service under CCP section 415.20(b) means leaving the papers at the person’s own dwelling, usual place of abode, usual place of business or usual mailing address, then mailing a copy. A property manager’s office is none of those for a resident, so papers are served at the unit, not handed to the leasing staff. Executive suites, virtual offices and private mailboxes

Around Michelson, Von Karman and Jamboree, plenty of companies rent a suite, a single desk or just a mailing address in a shared building. For a corporation or other entity, section 415.20(a) allows the summons to be left during usual office hours with the person apparently in charge of its office, followed by mailing; service is complete on the tenth day after the mailing.

When the only address reasonably known for a person is a private mailbox at a commercial mail receiving agency, section 415.20(c) allows service on the first attempt by leaving the papers with that agency in the manner the Business and Professions Code describes. A United States Postal Service post office box never qualifies. Knowing which kind of address you have changes how the choice between personal and substituted service plays out.

Suing or serving the City of Irvine

A summons for a city is delivered to its clerk, secretary or the head of its governing body (CCP section 416.50). Before a lawsuit for money damages, though, a written claim usually has to be presented to the city first, and no suit may be brought until the claim has been acted on or is deemed rejected (Government Code section 945.4).

The deadline is six months after the cause of action accrues for claims involving death, personal injury or damage to personal property, and one year for most others (section 911.2). The City of Irvine takes claims through the City Clerk’s Office at 1 Civic Center Plaza, using its own claim form.

UC Irvine is served through the Regents, not the campus

Section 416.50 names the Regents of the University of California as a public entity. A summons against the university therefore goes to the governing body, the Board of Regents, whose Office of the Secretary is at 1111 Franklin Street in Oakland, rather than to an office on the UC Irvine campus.

Serving someone who works or studies at UCI is another matter. That is personal service on the person, nothing more. Whether they can be served at work comes down to getting into the building, which is why we ask for the department, the building and their schedule.

Companies based in Irvine often have an agent somewhere else

A lot of companies have offices in Irvine, on Jamboree and Von Karman and around the Spectrum. A corporation can be served through the agent for service of process it has designated with the California Secretary of State (CCP section 416.10), and that agent is frequently a registered-agent company in another city.

Substituted service now, and the change coming in 2027

Substituted service on an individual is available only after personal delivery cannot be made with reasonable diligence, and it is complete on the tenth day after the follow-up mailing. For now the statute leaves “reasonable diligence” to the facts of each case.

Assembly Bill 747 rewrites section 415.20 from January 1, 2027. Under the new version, diligence is shown by attempting personal delivery in good faith on at least three occasions, on three different days, at three different times, and the follow-up mailing may go by first-class mail, Priority Mail with tracking or Certified Mail with return receipt requested. Who can serve papers in Irvine

Any adult who is not a party to the case can serve a summons (CCP section 414.10). Anyone who serves more than ten papers in a calendar year must register as a process server with the county clerk of the county where they live or have their principal place of business (Business and Professions Code section 22350), not the county where the papers are served. In Orange County that register is kept by the Clerk-Recorder.

Registration is also what opens a staffed gate under section 415.21, and the county and registration number appear on the proof of service.
