Process serving in American Canyon

Quick answer

Every civil case filed from American Canyon goes to one building: the Napa County Superior Court’s Historic Courthouse on Brown Street in Napa. The legwork happens here in town, on American Canyon Road, Newell Drive and the streets off Highway 29. Personal delivery comes first, substituted service only after reasonable diligence, and the signed proof comes back ready to file.

Process serving in American Canyon covers Highway 29 and American Canyon Road, Napa Junction Shopping Center, and master-planned subdivisions east and west of the freeway. There is no branch court in the city, so the case type decides only the department, not the building.

American Canyon sits at the southern edge of Napa County, next to Vallejo and the Solano County line. That matters more often than people expect: the person being served may live on one side of the line while the case is filed on the other.

What to send with an American Canyon order

  • The case number and the court where it was filed, even when that court is outside Napa County.
  • Home and work addresses, including whether the recipient works in American Canyon but lives in Vallejo, or the other way around.
  • For a store or office at Napa Junction or along Highway 29, the business name and the recipient’s role there.
  • Gate or call-box details for a subdivision with controlled access.
  • For an eviction, every adult you believe lives at the unit, named or not.

Napa County courthouses

The Napa County Superior Court has three locations, all in the city of Napa. Its Civil Division page lists general civil (limited and unlimited), small claims, unlawful detainer, family law and probate at the Historic Courthouse.

Historic Courthouse

825 Brown Street, Napa

Civil, small claims, unlawful detainer, family law and probate. Clerk’s office open 8:00 a.m. to 4:00 p.m. on weekdays.

Criminal Courthouse

1111 Third Street, Napa

Criminal matters. Not where a civil proof of service is filed.

Juvenile Hall Courthouse

2350 Old Sonoma Road, Napa

Juvenile matters.

What is particular about American Canyon

A small city with one courthouse to deal with, a county line on its southern edge and a lot of commercial frontage on Highway 29. These are the points that shape how papers get served here.

01

One courthouse for every civil filing

Unlike larger counties, Napa does not split civil work between branch courts. Limited and unlimited civil cases, small claims and unlawful detainers are all handled by the Civil Division at the Historic Courthouse, 825 Brown Street. The clerk’s office is open Monday through Friday from 8:00 a.m. to 4:00 p.m., and the court keeps a drop box for same-day filings until 5:00 p.m. If you would rather not make the trip, our court filing service handles the filing too.

The court also accepts electronic filing in civil cases, and its Civil Division page carries the forms to opt in to, or out of, electronic service under Code of Civil Procedure section 1010.6. Papers served after the case starts can go by email only to a party who is set up for it.

02

Right next to the Solano County line

Vallejo starts where American Canyon ends (see our Vallejo process server page), so it is common for a Napa County case to involve someone living in Solano County, or for a Solano case to reach an address here. A summons can be served on a person anywhere within California (CCP section 413.10). The county the recipient lives in decides where the server drives; it does not move the case.

The proof of service is filed with the court where the case is pending. A Vallejo case served in American Canyon goes back to Solano County, and a Napa case served in Vallejo still comes back to Brown Street.

03

Stores and offices along Highway 29

Many of American Canyon’s stores and offices sit on Highway 29 and at Napa Junction. When the person to be served works at one of those businesses, the first try is personal delivery on the job; our note on whether a process server can serve you at work covers the limits. If that fails after reasonable diligence, section 415.20(b) allows substituted service at the person’s usual place of business, by leaving the papers with a person apparently in charge who is at least 18 and then mailing a copy.

A clerk at the register is not necessarily “in charge” of the recipient’s workplace, so the server asks for the manager and writes down who took the papers. Service completed this way is effective ten days after the mailing. More on how this works is in our guide to substituted service in California.

04

Evictions in American Canyon

Unlawful detainer cases from American Canyon are filed at the Historic Courthouse like any other civil case, but the clock is shorter. Once served, the tenant has 10 days to respond, excluding Saturdays, Sundays and court holidays (CCP section 1167). If service goes through the Secretary of State’s address confidentiality program, the tenant gets five more court days.

Because the timeline is tight, the attempt history matters. Our guide on how many attempts a process server makes explains what a court expects to see before substituted service.

05

Serving or suing the City of American Canyon

A summons naming the city goes to its clerk, secretary or the head of its governing body (CCP section 416.50). If the case seeks money damages, a written claim usually comes first, and our guide on who can accept service of process explains who may take the papers for an organization (Government Code section 945.4): six months from the incident for injury or property-damage claims, one year for most others (section 911.2).

American Canyon’s City Clerk is at City Hall, 4381 Broadway Street, Suite 201, and the city takes claims through its City Clerk page.

06

Where Napa County servers register

Serving more than ten papers in a calendar year requires registration with the county clerk where the server lives or has their principal place of business (Business and Professions Code section 22350). In Napa County that is the Recorder-County Clerk, whose fee schedule lists process server registration, the bond filing fee and identification cards.

The registration county and number go on the proof of service, even when the papers were served somewhere else; what goes into an affidavit of service shows how. Our overview of process server laws in California covers the rest.

    Frequently Asked Questions

Answers specific to serving papers in American Canyon.

Where are civil cases from American Canyon filed?

At the Napa County Superior Court’s Historic Courthouse, 825 Brown Street in Napa. The court’s Civil Division there handles limited and unlimited civil cases, small claims and unlawful detainers; there is no branch court in American Canyon.

How is service handled at master-planned subdivisions?

When a guard or security staff is on duty, a registered process server who shows identification and proof of registration must be let in for a reasonable time to serve papers (CCP section 415.21). Gates run only by a keypad or call box are outside that rule, so the gate code or call-box details from intake are what get the server to the door.

Can a server work along Highway 29 or Napa Junction Shopping Center?

Yes. Stores and offices there can be visited during business hours, and a suite number plus a short description of the recipient helps. If personal delivery fails after reasonable diligence, papers can be left with a person apparently in charge of the recipient’s usual place of business and then mailed.

What if an American Canyon recipient is hard to reach?

Attempts can move to early mornings, evenings or weekends when weekday visits keep missing the person. If they seem to be avoiding service, a stakeout window can be added, and every attempt is written down for the diligence record. When no current address is known, skip tracing can come first. See also what hours a process server can serve.

How fast can service in American Canyon typically be completed?

A first attempt usually goes out within a few business days of the order. Faster handling can be requested when you order; how quickly it happens depends on the address and on the person.

Can address verification be added to an American Canyon order?

Yes. If you are unsure of an address, it can be checked against public records before anyone is sent, and the result is noted on the order.

The recipient lives in Vallejo but the case is in Napa. Is that a problem?

No. A summons can be served on a person anywhere in California (CCP section 413.10). The server goes to the Vallejo address, and the proof of service is filed back with the Napa County Superior Court, where the case is pending.

How long does a tenant in American Canyon have to answer an eviction?

Ten days after being served, excluding Saturdays, Sundays and court holidays (CCP section 1167). Service through the Secretary of State’s address confidentiality program adds five court days.

Can I file a proof of service at the Napa courthouse after 4:00 p.m.?

The Civil Division’s office closes at 4:00 p.m., but the court keeps a drop box for same-day filings available until 5:00 p.m. The court also accepts electronic filing in civil cases.

Who takes a claim against the City of American Canyon?

The City Clerk’s Office at City Hall, 4381 Broadway Street, Suite 201. A claim usually has to be presented before suing a public entity for money damages (Government Code section 945.4), within six months for injury or property claims and one year for most others.

Where does a Napa County process server register?

With the county clerk where the server lives or has their principal place of business (Business and Professions Code section 22350). In Napa County that office is the Recorder-County Clerk, which lists the registration, bond filing and ID card fees on its fee schedule.
